The detention of asylum seekers and irregular migrants in Europe has increased during the last several years. It is frequently the subject of official documents, studies and decisions of the Council of Europe (COE).
Established in 1949, the COE defends and monitors human rights and the rule of law in its 47 member states. Its actions are based on the European Convention of Human Rights.

Set up by the COE and linked to its administration is the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT).
